No Ballots For You: WTU Prez Liz Davis Sabotages Union Elections!

Here we go again. Washington Teachers’ Union (WTU) elections were supposed to be held in May 2016 and we are almost at the end of the school year with no ballots in sight. Ballots for union officer’s elections HAVE NOT BEEN MAILED TO UNION MEMBERS despite a WTU election timeline, which required them to be mailed on May 31st.  It is important to note that even that even the May 31st date is delayed as Officers-elect are required to be installed at the May meeting.

For those of you have been around six years or more – you may remember that former WTU President George Parker did not adhere to the union elections schedule in 2010. This delayed union elections until November 2010 and AFT, WTU’s parent organization imposed a “limited administratorship” to take over union elections for WTU, after several lawsuits were filed.

The WTU Constitution and By-Laws Section 2 K states:  “Officers of the Union shall serve three years, until their successors are elected and installed. Officers-elect shall be installed at the May meeting.”  President Davis  and the WTU Executive Boards’ term is slated to officially end on June 30, 2016.

The WTU Executive Board members were informed at our last board meeting on June 4th in fact no ballots have been mailed to teachers. Board members wanted to know why.

WTU Elections Chair Cheryl Gillette told Board members that Chief of Staff, Dorothy Egbufor failed to cooperate with the Elections Committee by submitting the union membership list to TrueBallot so elections can be conducted. Further, Gillette reported that TrueBallot was threatened by WTU Chief of Staff Egbufor that their contract would not be paid, despite the fact that Davis previously signed it.

WTU President Elizabeth Davis stated that she authorized the withholding of the union membership list from TrueBallot and threatened non-payment of an already signed contract.  Davis’ feigned excuses to the Board that she was concerned about the integrity of the elections process.

TrueBallot is the same reputable and experienced vendor that WTU contracted to hold the last union election when Elizabeth Davis ran for WTU president in May 2013. It also bears mentioning that WTU Elections Committee Chair Gillette was the elections chair in 2013 when Davis ran and the same elections procedures were followed by Gillette’s committee in the 2013 union election.

Without the membership list of union members along with their addresses, TrueBallot is unable to fulfill their contract to mail out ballots to union members.

It seems WTU President Davis is trying to take a page out of George Parker’s playbook.

How disingenuous for President Davis to announce via a June 2nd union newsletter last week that ballots were mailed out on May 31st. What does this suggest about Davis’ intentions? While sending a meet and greet invite to the entire WTU membership for several campaign mixers during the week of June 6th through 10th, President Elizabeth Davis DOES NOT TELL INVITEES THAT THE BALLOTS HAVE NOT BEEN MAILED!

As the WTU General Vice President, I also received an invite to Davis’ campaign meet and greet at my WTU email address even though I am running for WTU President on another slate, the Peterson slate. Go figure.

It’s also disingenuous that President Davis encourages WTU Building Representatives  to hold their local school elections by a May 31st timeline, yet fails to cooperate with our elected WTU Elections Committee in meeting our deadline to elect a new union president and officers.

And this from the incumbent candidate for WTU president who is running under the questionable banner of “The Responsible WTU Leadership Team”! Is it responsible to deliberately delay an election? Is it responsible to obstruct the duly appointed Elections Committee and use your Chief of Staff to throw every stumbling block possible in their way? Is it responsible to threaten a vendor with non-payment of services rendered after a fair and open competition that resulted in the award of a contract months ago?

Just like in 2010 - WTU Members have a right to move forward as quickly as possible with an election of new WTU Officers. Any continued delays by President Davis are a violation of union member’s rights that amounts to irreparable injury. Board members unanimously agreed that something needed to be done so that members could participate in a fair and democratic internal election.

The five motions passed by the Executive Board on June 4th showed their agreement that WTU incumbent President Davis should stop interfering with union elections and should cooperate with the Elections Committee in submitting the membership list to TruBallot.

Whether the elections happens in June remains to be seen. The Executive Board has given President Davis a deadline of Monday, June 6th at 12 noon to comply with submitting the membership list to TrueBallot.

Time is of the essence. If ballots don’t go out soon, Davis will become our second “HOLD OVER” un-elected union president. In 2010, union elections were delayed due to the following school year since teachers are generally on summer vacation in July and part of August. A delay in union elections will certainly further delay a negotiated contract for teachers.

Unfortunately, Davis has already missed one timeline given by her Executive Board to send TrueBallot an email by Saturday, June 4th with a copy to the Executive Board notifying them that they (TrueBallot) will be paid for services rendered upon completion.

It’s anybody’s guess what will happen next. Stay tuned  for more updates.

Last night our slate won! It was an exciting evening for the Saunders slate. Parker, hold over WTU President never showed up to watch the election results. The WTU Constitution requires that the winner receives more than 50% percent majority of the total votes cast. If none of the candidates receive more than 50% of the total votes cast, then there must be a run-off election between the two candidates who received the highest number of votes. In this case, Nathan Saunders received 334 votes and Hold Over WTU President Parker received 313 votes; therefore, there will be a run-off election between our two slates. The challenge ballots submitted by those who recently retired, resigned or were terminated were not counted.

We will need your continued support in the upcoming run-off election. Thanks for all of your support so far.

An Open Letter To WTU Members

Dear Washington Teachers' Union Members,

For years, we fought to make sure teacher voices were heard and due process rights were protected. Our actions were required when WTU “Holdover” President George Parker refused to act. Under his leadership, jobs were lost, unfair IMPACT evaluations were created and teachers suffered professional disrespect. Candi Peterson- a WTU Trustee board member and building representative - created theWashingtonteacher.blogspot.com, a reputable DC education online voice for teachers and school personnel in 2008. She has been an intelligent teacher voice and foundation for numerous DC education stories. Nathan Saunders, WTU’s two term General Vice President- spoke expertly as the legitimate opposition voice on education reform efforts which hurt DC students, parents, and teachers. We accurately forecasted teacher/school personnel terminations, oppressive working conditions and performance based mutual consent. We provided facts, analysis, and solutions. We created rallies and demonstrations after Parker “sold out” WTU members. We worked alongside parents to challenge disproportionate school closings in Ward 5 and some of our poorer sections of the city. This current election, which is more than six months overdue, was forced by our court action e.g. Saunders et al. v. WTU. Visualize our mutual progress if you entrust your vote and WTU resources to us!

We do better because we know better. The WTU can be a voice for members and can negotiate a better contract and improve working conditions. Without a change in President, the current state of confusion, failure to hold union meetings, ineffective advocacy, and weakness will continue to endanger your job and positive working conditions that facilitate teaching and learning. With the current union president Parker - you have no voice.

Nathan is the only candidate for union President with world class training in how to be a successful teachers union President. He is a Harvard Law School- Harvard Trade Union Program graduate and earned a Masters degree in Law and Ethics from the National Labor College/University of Baltimore.

If you are wrongfully terminated, it will be too late. Elect a strong President with excellent credentials and experience supported by an effective executive board who support a participative union democracy. Finally, There's Going To Be A WTU Election !

Although long overdue, members of the Washington Teachers' Union will finally have an election of officers. According to the WTU Constitution, union elections were supposed to be conducted in May with officers being installed in office on July 1, 2010. This has been a long protracted battle which began with AFT becoming involved in taking over the elections of the 15 member WTU Elections Committee in June 2010 because members had not been properly elected . Once elected, the elections committee members requested George Parker, WTU President (whose term ended June 30, 2010) to provide the necessary paperwork so that they could commence elections, Parker refused. Despite repeated appeals by elections chairperson, Claudette Carson to Parker requesting that he cooperate with elections committee members to move forward with a timely election, Parker dug his heels in the sand. What followed next was Parker convening a June 9 and June 15 Executive Board meeting and appointing four new board members illegally (Carynne Conover, Jacqueline Hines, Monica Jones-Martinez and Bill Rope). I was banned from these WTU meetings by George Parker as a WTU Board of Trustee member even though I have been an active participant in executive board meetings for three years. Parker with his newly appointed board in tow took the following measures of setting a new election schedule for the fall of 2010 stating that it was the executive's board's role to determine the elections schedule. Initially, Parker's crony, John Tatum who is appointed as a paid parliamentarian by the union president told the Washington Examiner newspaper that elections would be held in November with officers not being installed until January 2011. Later Parker and Tatum changed the date to a September election- perhaps after all the pressure.

What followed after Parker's election meddling were his retaliatory actions to reduce Nathan Saunders, WTU General VP's salary to a big fat zero while Parker continued to earn a hefty sum of our union dues in the amount of $150,000 and perks. Next, Parker also refused to sign Saunders DCPS leave of absence. Parker's actions left Saunders working for free and would have forced him back into the classroom at the beginning of school even though he was elected to office by the membership. Subsequently, Nathan Saunders, WTU General VP filed a law suit as did Claudette Carson, WTU Elections Chairperson to right these wrongs. Here's to Nathan and Claudette!

Suddenly but not surprising, the AFT became interested in 'talking resolutions' after the lawyers became involved. Heretofore, Randi Weingarten had basically said that this was a local matter and that she only wanted to "get in and get out" after the WTU Elections committee was elected. Certainly the lawsuits but also at the urging of The Washington Teacher blogger (yours truly) and other union members wrote letters to AFT President Randi Weingarten demanding a union election as well as the restoration of Saunders salary and approval of his leave of absence from DCPS. Even AFT members wrote to President Weingarten declaring how absurd it was for Local 6 not to conduct a timely union election and to reduce an officers salary.

Well union members, the power of the pen and a lawsuit here and there is mightier than the sword. Randi Weingarten of AFT heard your voices and decided to hold an investigation this summer into these local concerns at the AFT headquarters. I was in attendance at the AFT hearing and it appeared to me to be a 'kangaroo court' in which members of Randi's AFT Executive Council heard only some of the evidence. Might I add that all of my testimony as a witness was stricken from the record which is totally unacceptable. No real court in this land would allow such nonsense simply because they didn't like the content of one's testimony. I must say however, I was pleasantly surprised at the outcome of AFT's decision. This shows it is always best to reserve judgment until the end. Here are the results of the WTU Investigation and Order, dated August 4, 2010- as written by the AFT Executive Council:

1. AFT will take charge of the 2010 internal election for the WTU. This will include the officers, Executive board members, Trustees, Delegates to Metro Labor Council and Delegates to the DC and Maryland AFL-CIO.

2. a. the elections process will begin with a notice of nominations to the WTU membership informing the members of open positions for office, the term of office, the method to submit a completed nominations form, a copy of nominations form and the time and location for submitting such nominations.

b. the deadline for submitting nominations petitions will be that set forth

3. Those nominating petitions that have already been submitted will be accepted and they will be reviewed for their sufficiency and for any new petitions.

4. The eligibility cut-off date for WTU members to participate in the election will be the last payroll period in June 2010.

5. Fifteen days after the close of nominations, ballots will be sent by U.S. Mail to the WTU membership. The voting period will be fifteen (15) calendar days. The American Arbitration Association will be retained to conduct the balloting and certify the elections results consistent with the WTU Constitution and Bylaws.

6. The WTU will restore to Saunders his lost pay forthwith. The WTU shall also notify DCPS that Saunders' release time from the classroom should be extended at least through the conclusion of the election.

The Executive Council will retain jurisdiction over this matter to ensure compliance with its directives.

A lawsuit has been filed due to election tampering by George Parker, Washington Teachers' Union (WTU) President. According to the WTU Constitution, Parker's elected term ended June 30, 2010 and the new slate should have been installed July 1. Parker's cronie, John Tatum reported to the Washington Examiner earlier last month that the WTU would not hold union elections until November. Now they are saying union elections will be held in September. It's hard to believe anything these two say. Read about the lawsuit (below) that has been filed to address Parker's elections meddling as well as his retaliatory actions to reduce Nathan Saunders, WTU General VP's salary to a big fat zero while he (Parker) continues to earn a hefty sum of $150,000 and perks. Lawsuit Filed As WTU Election Fiasco Gets Personal by Alex Burchfield

"Who, exactly, is in charge of Washington Teachers’ Union? Current president George Parker’s term ended Thursday—at least as far as the union’s constitution is concerned. On July 1, new officers were supposed to take office. But the elections that would have determined who started a new three-year term then were never held—and now WTU’s leadership is locked in a court fight over what happens next. Vice president Nathan Saunders and the chairwoman of WTU’s election committee, Claudette Carson, have sued Parker for thwarting the election process and illegally cutting off Saunders’ salary.

Oh, and as it happens, Saunders is also Parker’s chief opponent to take over the union.The dispute over when, and how, to hold this year’s elections goes back four months. Unlike the usual hubbub of union politicking, this election bears heavily on the implementation of the newly adopted teachers contract—which will raise salaries an average $20,000 and create a merit pay system. The constitution stipulates elections for senior officials are supposed to be conducted every three years on May 30. The union’s election committee, elected in the spring of each year and composed of 15 nominated union members, runs the whole thing. Usually, candidates for officer positions must submit a nominating petition with 20 signatures to the election committee by April 30.

But Parker failed to turn in his nominating petition by the deadline, claiming the election committee originally in place wasn’t legally constituted because it did not meet its 15-member quota; thus, he didn’t have to submit a petition (see City Paper’s previous article). Parker argued that the other 86 candidates who submitted their petitions on the deadline were “trying to run a scam on [the] election” by using invalid petitions.

“This is a throwback to the unions in the 30s and 40s,” Saunders told City Desk. “Parker is saying, ‘I didn’t bring my basketball to the court, so I’m taking everybody else’s basketball.’”But Parker says otherwise: “What we have is Nathan Saunders playing an old-school election with invalid petitions.”

After the American Federation of Teachers—WTU’s parent organization—was called in to oversee the election of the 15 members of the election committee, it seemed Parker had nothing more to gripe about. The AFT decided to designate all future election decisions to the newly elected and legally constituted election committee, and would play no further role in the process. Parker, though, didn’t like the new election committee. So he kept withholding his nominating petition and refused to hand over the documents necessary to hold an election.

The complaint filed by Saunders and Carson (as you might expect) paints Parker as willfully obstructionist. During a meeting with Saunders, vice presidential candidate and blogger Candi Peterson, and AFT president Randi Weingarten, the complaint says, Parker told Weingarten, “I didn’t file my petition.” Weingarten responded, “George, you didn’t file your petition? I am stunned! I thought I had three candidates here representing three different slates, and I only have two.”

“Parker has run 100 times, so he certainly knew what to do,” Peterson told City Desk. “But for whatever reason he didn’t release the documents.”

Among his opponents, frustration with Parker’s conduct grew. When Carson, chairwoman of the Election Committee, requested that Parker deliver nominating petitions, union dues reports and the union’s only membership list in order to begin elections, Parker refused again. According to the complaint, Parker ignored Carson’s requests four times. Because the new election committee is composed of Saunders supporters, Parker’s solution was to transfer duties normally left with the election committee to the Parker-friendly executive board. With the unanimous support of the executive board, Parker decided all further elections would be postponed until fall, and that it was now the executive board’s duty to set election deadlines and provide the necessary documents.

To Saunders, that’s not fair. “The executive board never plays a role in the elections because they are candidates,” he says. “The election committee and executive board are not to be intertwined.”

Parker’s team is now making it personal, taking aim at Saunders, his main opponent. The board recently voted to revoke Saunders’s salary and refuse him a leave of absence. Since Saunders isn’t a teacher in DCPS, his salary is tied to the WTU payroll. The goal, Saunders and his allies think, is to force him to drop out of the running.

But beyond the personal disputes between Saunders and Parker, the indefinite suspension of the voting process has left many of the 4,000 teachers represented by the WTU feeling disenfranchised.

In an email sent to Parker by WTU member and Roosevelt High School teacher Thomas O’Rourke, the anger reaches a boiling point: “Your cynical manipulation and trampling of union democracy and worker tradition is both sad and disgusting and is directly responsible for the continuing decline of this union,” writes O’Rourke. “Know that, given the great amount of power under this Constitution you have, you will likely ignore this email and go on about your way, but know this: I, and others will make it our business to let the entire membership know of your nefarious conduct, your lack of accountability or even shame, and your cynical lies.”

It remains to be seen how the lawsuit transpires, but no one is too pleased about it.

“It’s unfortunate that we have to take these steps to go to court,” said Peterson.

As far as Parker is concerned, though, he’s still running the show. At a D.C. Council hearing two weeks ago, he told Councilman Harry Thomas Jr. that his term didn’t end until his successor took office.“The term of office for all officers is three years,” Parker said. “Ok, so what?” said Thomas. “Or until there – wait a minute.” “Or until?” “Or until their successors are elected,” concluded Parker. When that will be is now up to the court."

Why AFT President Weingarten stole my elected union job!

In April 2009, five Washington Teachers’ Union (WTU) members submitted petitions for elected office-The WTU Elections Committee. The unpaid job is small but important; the committee is responsible for verifying union meeting quorums, and conducting all general and special elections. Because fewer than the maximum number (15) members submitted certified nominating petitions, I was informed by the Elections Committee chairperson that I was duly elected immediately. The secret ballot requirement was trumped by a Department of Labor rule stating that uncontested elections requiring secret ballot are not necessary. I felt comfortable but little did I know things could turn crazy quickly.

The DCPS/WTU tentative agreement and its benefactors soon considered us liabilities. We were not good enough to conduct a contract ratification vote, a special election, or maybe we were too honest? The result is that ratification ballots have been sent out without a verified membership list and with a membership status, with the AFT/WTU’s endorsement, which can be changed so that new members can vote up until ballot submission. $164 million tentative agreement makes new friends easily with union members and integrity being meaningless collateral damage. All the stops have been pulled out to guarantee this contract ratification. I am appalled at the radio commercials encouraging teachers to vote “Yes” for the contract with funds union members did not approve, selected teachers have been gifted time from teaching in order to sell the contract to other teachers during the school day, and first time voting by telephone and the internet.

The final nail in our coffin came as a result of a discovery. Another elections committee member and I deduced WTU President George Parker did not file any nominating petitions to run for President. I informed all parties involved at which point the AFT increased its efforts to disband the elections committee. AFT President Weingarten desires an elections committee to give George Parker the opportunity to file nominating petitions, irrespective of the WTU Constitution. The answer is not a hard one for me because I have a renewed sense of fair play and rights of the common man and woman. How President Weingarten took away my right to hold elected union office is a crime. She did not even follow her own constitution and is now bulldogging her way thru our local. She stole from teachers for George Parker’s benefit furthermore her actions are related to the tentative agreement ratification. This denigrates our union, profession and intelligence. I only desired to provide mutual aid, support and collective action to my fellow teachers- maybe that is not unionism.

I am Claudette Carson, a union member who has tried to participate in my union’s democratic process. I never have been a WTU insider but I have always voted for candidates that would represent me. I am running again for the elections committee which I rightfully won previously but for the efforts of special interests. I understand the issues and the relevance of representing union members. I know firsthand the impact of dollars on relationships and will not allow you to be hurt as I have been. We can beat the culprits at their own game by getting this message out and voting May 27, 2010 at Logan School between 4pm and 7pm.
