Why AFT President Weingarten stole my elected union job!

In April 2009, five Washington Teachers’ Union (WTU) members submitted petitions for elected office-The WTU Elections Committee. The unpaid job is small but important; the committee is responsible for verifying union meeting quorums, and conducting all general and special elections. Because fewer than the maximum number (15) members submitted certified nominating petitions, I was informed by the Elections Committee chairperson that I was duly elected immediately. The secret ballot requirement was trumped by a Department of Labor rule stating that uncontested elections requiring secret ballot are not necessary. I felt comfortable but little did I know things could turn crazy quickly.

The DCPS/WTU tentative agreement and its benefactors soon considered us liabilities. We were not good enough to conduct a contract ratification vote, a special election, or maybe we were too honest? The result is that ratification ballots have been sent out without a verified membership list and with a membership status, with the AFT/WTU’s endorsement, which can be changed so that new members can vote up until ballot submission. $164 million tentative agreement makes new friends easily with union members and integrity being meaningless collateral damage. All the stops have been pulled out to guarantee this contract ratification. I am appalled at the radio commercials encouraging teachers to vote “Yes” for the contract with funds union members did not approve, selected teachers have been gifted time from teaching in order to sell the contract to other teachers during the school day, and first time voting by telephone and the internet.

The final nail in our coffin came as a result of a discovery. Another elections committee member and I deduced WTU President George Parker did not file any nominating petitions to run for President. I informed all parties involved at which point the AFT increased its efforts to disband the elections committee. AFT President Weingarten desires an elections committee to give George Parker the opportunity to file nominating petitions, irrespective of the WTU Constitution. The answer is not a hard one for me because I have a renewed sense of fair play and rights of the common man and woman. How President Weingarten took away my right to hold elected union office is a crime. She did not even follow her own constitution and is now bulldogging her way thru our local. She stole from teachers for George Parker’s benefit furthermore her actions are related to the tentative agreement ratification. This denigrates our union, profession and intelligence. I only desired to provide mutual aid, support and collective action to my fellow teachers- maybe that is not unionism.

I am Claudette Carson, a union member who has tried to participate in my union’s democratic process. I never have been a WTU insider but I have always voted for candidates that would represent me. I am running again for the elections committee which I rightfully won previously but for the efforts of special interests. I understand the issues and the relevance of representing union members. I know firsthand the impact of dollars on relationships and will not allow you to be hurt as I have been. We can beat the culprits at their own game by getting this message out and voting May 27, 2010 at Logan School between 4pm and 7pm.

Rhee To Hire 600 Teachers While Making Cuts To DCPS Staff

An inside source reports that DCPS principals were advised recently in a principals meeting that the Rhee administration plans to hire 600 new teachers for school year 2010-2011. On May 14, 2010, Chancellor Rhee appeared on the Kojo Nnamdi radio show with hosts Tom Sherwood and Mike Debonis . At that time Rhee indicated that up to as many as 400 teachers would be hired in the fall. So it seems this number has risen if we look at what was reported in a meeting with DC principals. It is not coincidental that George Parker, WTU president indicated back in March 2010 before WTU Representative Assembly members in a meeting that Rhee planned to fire 15% of WTU members through the IMPACT evaluation process in July 2010 . Roughly 15% of WTU membership equals 600 teachers/school personnel. That would mean that 600 teachers could be expected to be fired this summer. The million dollar question is how did Rhee know in March that she planned to fire 15% of our teachers through the IMPACT evaluation given that the process has yet to be completed ? Will the 600 teachers fired through IMPACT be replaced by the 600 new hires? These are questions we should all consider.

On another interesting note, many of our schools will face cuts to teaching staff by the end of June 2010. So far Cardozo SHS and McKinley SHS have been advised to expect teacher cuts in every department for the upcoming school year as well as cuts to other DCPS employees. This could represent as many as 15 teachers to be cut from both of these high schools. Other cuts which have been reported to date include 5 teachers to be cut from Luke C. Moore Academy. Should teachers ratify the WTU Tentative Agreement, many of the teachers who will be excessed from their schools may be terminated within two months if they are probationary status. If not, they would be forced to consider some unpleasant options: buy-out if monies are available, forced into early retirement if eligible and monies are available and or have the option of a 1 year extension to continue to work as a tutor or long term substitute assuming they have a satisfactory performance rating or better. As most of you know Rhee's five year education plan seeks to rid our schools of a significant share of our teacher workforce through buy-outs, terminations, forced retirements and lay offs. Worst possible scenario, DCPS employees could face another reduction in force for the upcoming school year 2010-2011.

Inquiring minds want to know how Rhee is allowed to continue spending willy nilly without regard to the 528 million dollar budget that DC government currently faces. To date, Rhee has not been required to place a freeze on hiring and spending practices. While CFO Gandhi and Chancellor Rhee have proposed to rob Peter to pay Paul in our DCPS budget in order to fund the WTU Tentative Agreement, it seems that one thing we can be assured of more teacher and staff cuts are on the horizon.

WTU's George Parker Fails To Submit Petition For Re-Election Bid For Union President

According to a press release sent to The Washington Teacher today, the author states: "For the first time in the history of the Washington Teachers Union (WTU), a sitting union president has failed to submit petitions to run for office in accordance with the requirement of the WTU Constitution and By-Laws rendering him ineligible to run for office." On May 10, 2010, during a special meeting at the headquarters of the American Federation of Teachers, George Parker, current President of the Washington Teachers’ Union (WTU), announced to Randi Weingarten, President of the American Federation of Teachers (AFT), Nathan Saunders, presidential candidate for WTU 2010 election, Candi Peterson, general vice presidential candidate for WTU 2010 election and others that he failed to submit nominating petitions for the upcoming General Election of WTU officers. The press release cites the WTU Constitution and By-Laws (Article 7, paragraph 2.C) which states “Official nominating petitions shall be made available to the membership at the March meeting or at the WTU office. Petitions must be returned to the office of the Washington Teachers’ Union on or before the close of the last regular working day of the Union in April. Verification of the receipt of each nominating position shall be in writing.”
WTU rank and file members believe that AFT's national president Randi Weingarten will resort to illegal means to keep George Parker in power at any cost even if it means over ruling a WTU constitutional requirement that states that petitions for the election of union officers be submitted on the last working day in April. Even though Randi Weingarten stated in our May 10 meeting that she only wants to 'get in and out' in order to assist with the WTU elections committee process, let's watch what Randi does in the days ahead. I believe Randi will do whatever it takes to undermine the ability of the other presidential candidates likelihood of success, particularly Nathan Saunders because she fears opposition from him on the WTU Tentative Agreement. With WTU George 'sell out' Parker at the helm, there is a greater probability that the WTU T.A. will be ratified. Stay tuned as this drama unfolds.- Candi Peterson, Blogger in residence

Open Letter To DC City Council Chairman Vincent Gray

Dear Chairman Vincent Gray:
I wanted to make you aware that the Washington Teachers' Union Tentative Agreement will provide retroactive pay raises dating back to 2007 only to 'active teachers' and 'laid off teachers'. There are concerns that this tentative agreement was negotiated in bad faith by Chancellor Rhee, AFT President Randi Weingarten and WTU President George Parker and intentionally excludes recently retired teachers and school personnel.
What is troubling is that teachers and related school personnel who worked during the terms of this contract period (2007-2012) should be eligible for retroactive raises for the time that they worked. No collective bargaining agent nor the District of Columbia government should enter into an agreement that extends rights and benefits to only some union members while excluding other eligible union members. This is tantamount to cheating people out of raises that they are entitled to and subsequently shortchanging their retirement benefits.
I ask that as the DC City Council approaches an upcoming hearing to discuss the feasibility of funding the WTU Tentative Agreement, that the exclusion of providing retroactive pay raises to eligible members be addressed with Dr. Gandhi and Chancellor Rhee. Certainly excluding entitled union members under this Tentative Agreement could pose a liability for the District of Columbia government and is not consistent with past practices. This matter needs to be explored further by the Committee of the Whole. I have utmost faith in your willingness to investigate this matter. No Money For You DC Teachers !

This just came in. Gandhi to Rhee: "Surplus does not exist."
Bill Turque of DC Schools Insiders blog reported "that District Chief Financial Officer Natwar M. Gandhi just released a letter he sent to Chancellor Michelle A. Rhee saying that the $34 million surplus she cited Tuesday as a basis for helping to finance teacher salaries under the proposed new labor contract "does not exist." Gandhi's finding could throw the status of the tentative agreement with the Washington teachers' Union into serious doubt."
According to Turque: "Gandhi's finding, conveyed to Rhee in a stinging letter late Thursday is likely to open up a whole new chapter of contention in tortured history of the contract, which has been in the works since the end of 2007. While his (Gandhi) assessment appears to defuse charges that Rhee opted to sock away money for a new contract rather re-hire teachers laid off in October, it clearly undermines the financial foundation of the $140 million deal. Gandhi told Rhee that while there is a projected $34 million of under-spending in the school operations sector of the current budget, that is offset by an estimated $30 million in over spending in the system's central office operation. In unusually blunt language, Gandhi also took Rhee to task for what he called a failure to adequately consult his office before revealing the surplus at a meeting with D.C. Council members. "I was incredulous to learn that in your April 13, 2010 presentation to the Council on the contract you asserted that a surplus is available to fund the proposed salary increases based on preliminary information," he wrote."

WTU Tentative Agreement = 1000 Ways To Kill DC Teachers

Given that DC public schools excessed approximately 600 plus teachers last school year, there is reason to believe as many DC teachers will be excessed in June 2010 due to impending school system budget cuts and school restructuring slated to take place. According to the Washington Teachers' Union Tentative Agreement (T.A.) by definition, "excess is an elimination of a teacher’s position at a particular school due to a decline in student enrollment, a reduction in the local school budget, a closing or consolidation, a restructuring or a change in the local school program when such an elimination is not a reduction in force (RIF) or abolishment.” (page 5 of WTU T.A.) Should DC teachers be excessed under the proposed agreement, there is a great likelihood that excessing would lead to termination as there would no longer be a requirement for placement according to system seniority.
Rather than have the central office place teachers into existing teacher vacancies, principals would now be able to hand pick who they want (aka mutual consent) under the WTU Tentative Agreement negotiated by WTU President and chief negotiator George Parker and AFT President Randi Weingarten. NYC Educator, a NY public school teacher turned blogger wrote that mutual consent “is a misleading term. What it actually indicates is that principals get a veto on any incoming transfers." By definition in WTU’s T.A., mutual consent means no teacher shall be placed without the teacher’s and supervisor’s consent (page 27).
Mutual consent has been negotiated in other teacher union contracts in places like New York where Randi Weingarten, now AFT President negotiated this clause as the former United Federation of Teachers Union (UFT) president. Many New York public school teachers believe that the mutual consent provision led to the explosion of what is now known as the absent teacher reserves (ATR) in their state. In New York, teachers are part of an pool of teachers and continue to draw salaries while awaiting job placement. Some work as substitutes while others seek employment opportunities daily as they wait to be hired. This has led to thousands of teachers being paid and has contributed to an 81 million dollar growing debt.
So it seems that teachers and related school personnel in DC could suffer an even worse fate than our New York counterparts. While the WTU T.A. does not specifically address the absent teacher reserves like in New York, it does suggest that eligible permanent teachers with effective or higher ratings have the option of being placed into what amounts to a teacher reserve for one year if they cannot find a mutual consent placement. For all other teachers, the WTU T.A. implies that probationary teachers regardless of annual performance ratings, teachers who opt in for individual performance based pay regardless of annual performance ratings and permanent teachers with less than effective ratings will be terminated within a two month time frame if they cannot find a mutual consent placement after excessing.
Permanent teachers with an effective rating or higher will face a number of obstacles in securing the three options available to them under this agreement if they are excessed. While they can select a $25,000 buy out or an early retirement with 20 years or more of creditable service, the catch is these options would be subject to government and budgetary approval. The Tentative Agreement clearly states in Article 40, on page 103, that “Nothing in this Agreement shall be construed as a promise that Congress, the DC Council, or any other organization shall appropriate sufficient funds to meet the obligations set forth in this Agreement.”
In addition, should eligible teachers select to work an additional year, they must make a substantial effort to interview at a minimum of five schools or interview for all vacant positions for which they are qualified if the total number is less than five. Teachers assigned the one year extension would be assigned in one or more capacities to include one on one tutoring, small group instruction, class coverage, long term teacher replacement or central office support. If at the end of the calendar year, teachers had not secured a mutual consent placement, they would be terminated as well.
Given the WTU Tentative Agreement includes undisclosed side letters which were crafted in part by mediator Kurt Schmoke, Washington Teachers' Union members, as well as the DC City Council and DC residents must demand that these written documents be made readily available for review to union members and the DC City Council. Although previously promised, WTU members are still awaiting receipt of the WTU Tentative Agreement in the mail. I strongly encourage all WTU members to read the 103 page Tentative Agreement in its entirety and request a written legal opinion from our WTU Legal Counsel, Lee W. Jackson of O'Donnell, Schwartz and Anderson. As always the devil is in the details.

Knock, Knock Wash. Teachers' Union Prez George Parker, Anybody There ?

On December 15, 2009- the WTU Executive Board passed a motion to appeal Judge Judith Bartnoff's November 24 legal decision . In Bartnoff's decision she ruled against the Washington Teachers Union Temporary Restraining Order (TRO) and preliminary injunction which was filed to have approximately 266 unfairly laid off teachers and school staff reinstated. 
Whether you agree or disagree that an appeal should be filed on behalf of DC teachers, the WTU Executive Board has spoken by a vote of 5 yes votes to 3 no votes with 5 board members abstaining. WTU President George Parker agreed to contact our WTU attorney Lee Jackson on December 16, the day after the E-board meeting to request that he prepare an appeal of Bartnoff's ruling by the December 24 deadline. 
Union transparency is important because it encourages union officials to do the right thing on behalf of our members. As an elected union official, I along with other WTU Executive Board members continue to come up against stumbling blocks with our union president, George Parker in that he refuses to answer pertinent emails of inquiry from Executive board members regarding union business and has been accused of not being responsive to our membership as well. I give WTU President Parker an 'F' grade on union transparency, answering pertinent emails of inquiry and follow through on behalf of our members. This is just not acceptable to me nor should it be to you. I am adamant that the Washington Teachers' Union be a union for the people, by the people and with the people- not a dictatorship. Maybe you can help me ?
Knock, knock Washington Teachers Union Prez George Parker, anybody there ? Well I guess not because I along with WTU Executive Board members Sheila H. Gill and Nathan A. Saunders have sent  emails to you and have yet to hear even a whisper. Can anybody, pleeez encourage Mr. Parker to answer our emails. In the advent that any of you should accidentally run into him- could you share my December 23 email and ask him to respond to me ? After all I am an elected official to the WTU Board of Trustees. Here's my most recent email:

In response to the previous emails, the federal government was open for business on Tuesday and Wednesday as I hope the WTU is. Federal government workers are required to use annual leave if they decide to take off during liberal leave conditions which existed on Tuesday. Businesses in this area are resuming work today and that should be the expectation for our union as well. In light of this, I do hope that the WTU will set a date for a meeting with our union attorney whether George is in the office or not, in addition to providing members updates on the status of the legal appeal which passed on 12/15/09. 
On behalf of our union members, I would like to request that a rescheduled meeting date be set with our WTU attorney, Lee Jackson as soon as possible in order that board members can arrange their schedules.  There should be no reason that we cannot follow up and commit to setting up a date with Lee Jackson as a great deal of time has passed already. It appears that not only board members but teachers have a lot of unanswered legal questions that they would like to address with our union attorney. In the spirit of working on behalf of our members, I request that you provide a rescheduled date and time by no later than Thursday, December 24 close of business @ 5 p.m. to all board members.
I also would like to inquire what is the status of Lee Jackson's appeal on behalf of DC's RIF'ed teachers as December 24 is the due date for the filing of the appeal as we discussed in our last rescheduled WTU board meeting. I would also ask that this information be provided via email when you respond about the rescheduled meeting date with Attorney Lee Jackson. Thanks for your urgent attention in this matter and I along with others await your timely written response by tomorrow close of business.

A RIF'd DC Teacher Issues A Challenge

OPEN LETTER TO ALL 

Dear DCPS Employees Past and Present, Parents, Guardians, Students and DC Community:

I am writing this letter to issue a challenge to us all. We as a system are under fire. For those of you that are still in the classroom please do not be lulled into a false sense of security. This school system is under attack and teachers are on the front lines.

In the past few weeks it has become clear that the Washington Teachers Union is either unwilling or unable to protect and successfully defend us, so we must do it ourselves. I and some of my other friends have been on a letter writing campaign and have sent letters to everyone from the DC City Council to President Barack Obama. My focus right now is Oprah Winfrey. It may sound silly but understand that Ms. Winfrey profiled Michelle Rhee as one of the most powerful women in America and is planning on having her on the show.  I think that it is important that we get our side of the story to her. Michelle Rhee has been allowed to control the press for far too long. (Contact Oprah's website by clicking this Link . Scroll down and click contact us ). 

I have sent letters to Oprah but if we flood her website she will be forced to at least investigate what is going on. It only takes a few minutes to go to her website and click on “contact us” and send an email. We all have a story now it is time to tell that story. From former Principals, to teachers, to custodians, to office staff, and to the students, it is time that we go global with our story. Talking on the blog is great but we are preaching to the choir.
