Three Years And Counting, And No WTU Contract for You!

Mass emails were sent out to many DC Public Schools teachers on the Columbus day holiday to their DC government email accounts and some personal email accounts from a relatively unknown teacher who refers to himself as Coach Spinner.  You may recall Coach Spinner as he ran against me for WTU General Vice President position on the Saunders slate in 2013 and lost.

The subject of the email sent to members was titled the “New WTU” and introduced readers to a blog which harshly criticizes current WTU President Elizabeth “Liz” Davis for failing to address Impact-teacher evaluation system, financial malfeasance and failure to get a union contract which is the union president’s primary responsibility as the “Chief Negotiator.”

Based on a little digging, I have learned that Coach Spinner is a campaign surrogate for former WTU President Nathan A. Saunders who lost his bid for presidency in 2013. So it seems according to a former WTU staffer now working for him, Saunders wants another shot at the WTU presidential seat. No surprise here.

When I asked union members if they knew who Coach Spinner was their typical response was they did not know him. One of the current WTU Executive Board members who requested anonymity agreed that she didn’t know the person sending her the email about the new WTU. She said, “I thought someone had fed him (Coach Spinner) information because he seemed to know a lot about the state of WTU affairs.”

Using a surrogate in politics is a common practice to launch an election campaign. The surrogate is usually someone who can step in and deliver a message on behalf of the candidate, rally the supporters and in this case represent a failed brand. 

One might ask why Saunders' would need a campaign surrogate? I think the Saunders’ team is likely using this surrogacy as a strategy because they don’t want teachers to remember the wreckage Saunders' left behind during his years as elected WTU officer from 2007-13. Putting his former running mate with little to no name recognition, out in the forefront is a way to deceive the union membership.

As you may recall, Saunders' refused to gracefully exit the WTU headquarters in 2013  at the end of his term (June 2013) and extended his stay an additional 30 days in violation of the WTU Constitution and By-Laws with the blessings of his Saunders-friendly election committee. I covered that story on The Washington Teacher blog.

Saunders refused to cooperate with a former WTU Executive Board while General Vice President in his second term, and was later exiled back to the classroom for failure to provide the board the requested accounting of the work he had performed on behalf of members, while an officer.  

I believe Saunders also lost credibility with teachers when he summarily dismissed me as the General Vice President in 2011 without due process and robbed members of their vote. This decision on Saunders’ part, sanctioned with the approval by the then WTU Executive Board cost our union hundreds of thousands of dollars in legal fees alone. By the way, Coach Spinner was a member of the WTU Executive Board who rubber stamped Saunders’ request to oust me. I think one of the main reasons Saunders wanted me out was because he preferred a top down management style where he alone could rule with an iron fist...

While some of Coach Spinners' accusations against WTU President Liz Davis are accurate, they only represent half-truths.  

President Liz Davis can’t be let off the hook for not being transparent about the current state of union affairs, the status of contract negotiations or what has happened to the VEBA (Voluntary Employment Beneficiary Association account funds for eligible retiring teachers) and why the District has refused to provide anymore VEBA payments to the WTU since 2013.

Davis has vacillated about what the real problem is with contract talks and has not been totally honest. Initially, Davis blamed the Chancellor for failing to regularly meet with the contract negotiations team.

What Davis has not disclosed to members, is that she failed to cultivate a working relationship with Chancellor Henderson and her team from the outset. When President Davis refused to attend bi-monthly meetings with the chancellor’s team, this set the stage for a break down in union/management communication. Davis later aborted central office meetings I attended in order to resolve teacher issues claiming it compromised contract negotiations. Open communication with management is vital to the success of negotiating any contract and resolving teachers' issues.

Members have been recently informed by Davis that a mediator will be brought in to assist WTU and DCPS with contract talks with no details about the impasse that led to need for a mediator. As a non- member of the contract negotiations team, I think it is important for members'  to understand what has actually transpired.

Certainly members should demand transparency and accountability from President Davis. Union members have the right to know the status of the unions' financial affairs and all other matters...  Members also have an obligation to request to see detailed financial records, bank statements, mortgage loan statements, internal auditor reports, proof of WTU staff/officer’s income, expenses and benefits, Executive Board meeting minutes, copies of VEBA bank statements and other forms of documentation, etc.

My problem with Saunders and Spinner is that, they don't have 'clean hands' and certainly neither of them should be the ones to point the finger of blame at anyone.

Here are some important information about Saunders:
*Saunders didn’t deliver a teacher contract during his term as union president from 2010-13

*Saunders did not address many of the IMPACT teacher evaluation issues despite his campaign promises

*Saunders fell behind in dues payments to AFT in 2013, our parent organization leaving WTU at risk for an administrative takeover

*Saunders allegedly paid himself more than his 2010 board approved salary of $160,000 and appears to have paid himself as much as $240,000. However, given that WTU President Liz Davis did not proceed with conducting a forensic audit, we can’t be sure of how much beyond this was spent.

*Saunders did not leave $1.7 million in the VEBA account as reported! This money had not yet been forwarded to WTU prior to Saunders’ departure at the end of July 2013.

*Saunders left WTU with an office building that is strapped in debt with 3 mortgage loans totaling 4,885,904, almost 5 million dollars. The Pennsylvania Avenue historic building is a money pit. A construction loan had to be converted to a mortgage loan.  A second mortgage loan had to be guaranteed by our parent organization, AFT. There is a financial covenant which requires a minimum debt service coverage ratio. There has been no default of the loan to date, however, under Davis there have been violations of the debt covenant which the bank has agreed to waive.

Certainly, it is highly probable that we could have found a building in Washington, DC much cheaper than the 5 million dollar price tag of our current headquarters. The extensive cash reserve (a million plus) left over when former President George Parker vacated office in December 2010, no longer remains in the union coffers, thanks to Saunders.

When I spoke to 42-year veteran DCPS teacher, Emily Washington about the unfolding of events, she asked, “Why now? Saunders’ timing is suspect and it represents Déjà vu all over again.  People who want this office sit on their butts until it’s time to have another election.  Saunders and Coach Spinner certainly have had the opportunity to bring these issues up before now. You never see them at union meetings, or  any of the union sponsored events. In fact, since the Saunders' and Spinner's defeat, they have been conspicuously MIA (missing in action).  We need to re-examine who gets elected as an officer and who gets elected to the executive board.”  

My conversation with Ms. Washington echoed how I have been feeling for some time. I agree that the functionality of an organization is tied to its officers, its’ executive board, as well as its' members. If a board is dysfunctional then it affects what happens within the organization.

As an outspoken union member and officer, I've been frustrated on the union Boards that I have served on and often felt like some board members were more concerned with remaining loyal to the president than abiding by our unions' Constitution and by-laws. I have been a lone dissenter followed by one or two others willing to challenge the status quo.

There is an obligation on the part of all union members, especially our elected officials to ask the necessary critical questions, to speak up, to be transparent with the membership and to make the tough decisions required of a governance body in the face of unethical leadership, suspected malfeasance or impropriety, not just at election time.

The WTU Throws In The Towel On DC's Laid Off Teachers And School Counselors


A WTU Executive board member, Sheila Gill wrote to the WTU President George Parker and members of the WTU Executive Board and Board of Trustees expressing concerns about the direction the Washington Teachers Union is taking by scheduling a meeting with laid off teachers to discuss retirement benefits (see email from M Lenoir below). What is concerning is that the decision to host a retirement seminar was done so without even notifying members of the executive board and board of trustees. I too am disappointed that the WTU under the helm of Parker is ready to throw in the towel on DC laid off teachers. It seems that we are in desperately in need of a strategy to combat these teacher and staff lay-offs. Don't you agree ?

 Most of you have written what's next ? Your guess is as good as mine. From where I sit- it looks like the WTU's strategy after the rally for respect is to encourage laid off teachers to go ahead and retire.

"I'm confused. What are you doing about getting the RIF'd employees their jobs back ASAP? Who doesn't know how to retire? We are educators, we can read or do research on how to retire. The question to you again, "What are you doing about getting the RIF'd employees jobs back today ? I'm disappointed in your direction of resolving the reduction in force issue,if your intent is to discuss retirement benefits/process. Please be a part of the solution and not the problem. I am very concerned about the purpose of the meeting scheduled for Thursday, October 15 from 
10:00 AM- 12:00 Noon at the Peoples' Congressional United Church of Christ."

Cover Up of DC Teachers Protests by The Washington Post

In typical Washington Post style they cover up the news rather than report the news. Bill Turque who attended our rank and file teacher rally wrote a story for The Post and it appeared on line on Thursday evening. As is customary, the WaPo article generally appears in the on-line version and then appears in the Wash. Post the next day. This time that did not happen. Surprising ? No. I suspect that now that Chancellor Rhee and Mayor Fenty are losing favor with many in this city we will see little to none of Turque's article. The only coverage that appeared in their paper was a photo from our teacher rally featuring our very own Sheila Gill, WTU Executive Board member and school counselor holding a rally sign.

Well if the Post won't report their news I certainly will. Here is our story that should have been printed in The Washington Post.

D.C. Teachers Rally Against Rhee, Union Head

"A small but vocal band of District teachers, angry about impending layoffs, rallied against Chancellor Michelle A. Rhee and their own union president in front of the school system's central offices early Thursday evening.

"Our teachers are running scared right now, because they're not sure they'll have a job," said Malvery Smith, a second grade teacher at Turner Elementary School@Green in Southeast. Smith, who has taught in the city for 14 years, was one of about 60 District educators in the plaza in front of school headquarters on North Capitol Street.

They were joined by supporters and community activists. Teachers protested Rhee's Sept. 16 announcement of a still-unspecified number of layoffs. It came more than three weeks into the school year and nearly seven weeks after the D.C. Council sliced $20.7 million from the 2010 DCPS budget. The cuts, which also hit other city agencies, were triggered by a continued decline in tax revenue.

Teachers who will lose their jobs are expected to be notified by Sept. 30. Word of the layoffs followed a spring and summer when the school system filled 900 teaching vacancies. Rhee said she did not expect the council's cuts, which were approved July 31. She waited until mid-September, she said, so that the staff reductions could be done in tandem with the annual "equalization" process, which shifts teachers at under-enrolled schools to others in need of more educators.

But teachers scoffed at that explanation Thursday, contending that Rhee is seeking another way to oust veteran instructors. "That doesn't hold water," said Willie Brewer, an instrumental music teacher at Marshall Elementary in Northeast who has worked in District public schools for 26 years.

Jerome Brocks, a veteran special education teacher said there was only one reason Rhee is pursuing the cuts. "It's to get rid of veteran teachers of color," said Brocks, who is black.

Rhee has denied targeting teachers because of age or race. Washington Teachers Union President George Parker did not attend the rally, which was organized in part by two of his most outspoken critics, union board of trustees member Candi Peterson and its general vice president, Nathan Saunders. They have denounced Parker for weak leadership and aligning himself too closely with Rhee in contract talks that have lasted nearly two years.

The District's 4,000 union members have been without a contract for three years. "Our union leadership has led us to this point," said Tom O'Rourke, a social studies teacher at Roosevelt High School. "Management knows they can wait us out and pick us off one by one."

Parker said the union didn't endorse the rally because it was "hastily and loosely organized. "It did very little to serve the interests of our members, although it may do a lot to serve the political interests of Candi Peterson and Nathan Saunders," he said.

Parker said the teachers union will hold a rally Oct. 8. It has been a turbulent first few weeks of the new school year for D.C. teachers, who have been trying to adjust to a series of changes made by Rhee.

In addition to the impending layoffs, the District has unveiled a new, rigorous evaluation system that will include improvement in standardized test scores as part of the criteria for assessing some instructors. It is linked to a deeply detailed new set of teaching guidelines and strategies that cover everything from classroom presentation to checking for student understanding to instilling the belief that hard work leads to success.

School officials have also introduced a revised version of the student disciplinary code that is intended to de-emphasize suspensions and push teachers to work harder at keeping misbehaving students in the classroom."

DC Teachers Deserve A Better Union President than George Parker

Teachers Deserve a Union President That is Good 4 Teachers

The Washington Teachers' Union under the leadership of union president George Parker is in dire straights. Too often Mr. Parker is as petty as they come. A DC teacher I know and longstanding and actively involved union member frequently refers to Mr. Parker as "Petty Eddie." I now understand why.

After a 4/27/09 entry on the DC Wire blog titled 'WTU Veep Sent Back To School,' WTU General Vice President Nathan A. Saunders sent an email to our executive board and board of trustees. I have learned based on reading Nathan's email that teachers' union president George Parker has yet to approve his leave of absence application to continue on in his elected role as the vice president of our union. What's interesting to note is that Parker , an elected official like Mr. Saunders, approved leave of absences for himself and certain members of the WTU staff.

Parker's delay tactic is not uncommon. He often fails to acknowledge board members concerns unless we email American Federation of Teachers President Randi Weingarten. It is not uncommon for Parker to also ignore constituents emails, or claim he is just so busy tending to union business that he is unavailable. Parker's latest act is unconscionable.

As a member of the union board of trustees, building representatives for teachers and related school personnel, as well as one who has served on union committees- I have seen first hand Parker's refusal to comply with motions passed by our executive board. He frequently fails to represent teachers in the media as required by our constitution , often doesn't make timely business decisions, fails to communicate, mismanages our union office, regularly cancels board and representative assembly meetings, excludes critical union stakeholders from having input and withholds portions of the truth from our membership. As noted on this blog earlier this year, members of our WTU executive board passed a motion in spring 2008 to seek the assistance of the American Federation of Teachers (our parent organization) due to board members concerns regarding Parker's poor management of our local.

DC teachers continue to complain that our union office under the sole helm of Parker has been ill equipped to respond to members telephone calls, complaints and concerns. With an increase in teacher complaints due to Rhee's 90-day-termination plans, Parker has been unwilling to compromise with board members requests that an administrative assistant is desperately needed for union field representatives. It is common knowledge that many who have been placed on 90 day termination plans by the Rhee administration still lack the promised administrative supports (i.e. helping teacher, etc). Little wonder why chief negotiator Parker couldn't negotiate a teachers union contract with Rhee without the assistance of the AFT.

While it pains me to post this email from WTU V.P. Nathan A. Saunders, I do so because I believe that DC teachers deserve a union president who is willing to act in the best interests of our union members and not like some woman suffering from PMS. (Posted by The Washington Teacher).

WTU Executive Board and Board of Trustees:

This email is written to inform you that Deputy Chancellor Kaya Henderson has issued a “report for duty or be terminated” directive to me dated April 20, 2009. Her letter states the reason for this directive is that the official “DCPS leave of absence application” I submitted, is “not sufficient.” She asserts that “proper application” requires a memorandum of agreement signed by the WTU President. I have provided WTU President George Parker with a memorandum of agreement for his signature but, he has not signed it thereby negating my ability to submit the leave of absence application.

Article XVIII (E)(5) states “upon proper application, permanent teaches may be granted a leave of absence without pay for (1) school year to serve as a full time employee of the Union….” Deputy Chancellor Henderson states that WTU President George Parker’s signature is required for DCPS to grant my leave of absence.

In my attempt to secure his signature, he informs me that it may take some time “due to his heavy workload.” (see email attachment)

I am in receipt of your envelope around 4 pm today left on my desk by Herb Thomas on Friday. I have not had an opportunity to review the information but will do so ASAP given my heavy workload ( preparation for negotiations, placement of excessed teachers, transition to People Soft, 90-day plan, school restructuring, teacher certification notices, etc.). Once I have had an opportunity to review the documents and consult with the WTU attorney, I will get back with you immediately.

In the meantime, if there exists any reason why you feel I should not take reasonable time to review and investigate all documents and information associated with this issue, as well as seek appropriate legal counsel from the WTU attorney, before taking any official action on behalf of the WTU, please provide the reasoning behind such urgency.

As you are aware, leave of absence to work for the union is a collective bargaining issue and how we resolve associated conflicts can possibly become precedent setting for future contract interpretation. Therefore it is critical that we analyze all facts that led to this unfortunate incidence, how to avoid this in the future, and legal options for resolution.

Finally, to date, as WTU President I have received no official notification from you that you have reported for duty as a full-time DCPS ET15 WTU bargaining unit member at Eastern SHS, although rumors are that you reported. Please advise. I will get back to you within the next 72-96 hours.

Knock, Knock WTU President George Parker - Anybody There ?

Union transparency is important because it allows workers to make informed decisions about the value of union representation. It also encourages union officials to do the right thing like spend union monies appropriately on union members interests such as grievance issues, member services, bargaining, benefits, and professional development, etc. As a union official whose role involves financial oversight- I have come up against some stumbling blocks with our union president that I am just not willing to remain silent about. I am adamant that the WTU adhere to the necessary 'check and balances' when it comes to financial matters so that we don't repeat the mistakes of our biggest scandal ever- the Bullock administration. Maybe you can help me ?

Knock, knock Washington Teachers Union Prez George Parker, anybody there ? Well I guess not because I have sent numerous emails to you and have yet to hear even a whisper. Can anybody, pleeez encourage Mr. Parker to answer my emails. In the advent that any of you should accidentally run into him- could you share my latest email and ask him to respond to me ? After all I am an elected official to the WTU Board of Trustees. Here's my most recent email:

Dear George:

As a WTU Board of Trustee member, I have requested information from you in your official role within the WTU. To date I still have not received an answer or any acknowledgement from the WTU president which is troubling to say the least. Failure to respond to an official written request from an elected union officer is at the very least unethical and may be perceived by our constituents at some later date as an 'intentional desire' on your part to refuse to comply with legitimate requests as well as a failure to adhere to our WTU Constitution and By-Laws.

Be that as it may, I am requesting again that the subject of the 'wire transfer' be placed on the February 26th WTU board agenda. I also would like to request that copies of my four emails be made part of the official record of the WTU. As I have previously requested, I still would like to get answers to the questions that I've posed . I would also like to formally request any and all documents concerning what is being referred to as the 'AFT grant' at the February 24th WTU representative assembly.
